
According to law enforcement sources, a former U.S. Marine named Daniel Penny has been indicted by a grand jury in relation to the death of Jordan Neely, who died as a result of a chokehold aboard a subway train.
The specific charges will be revealed in court when Penny makes an appearance on a later date. Initially, Penny was arrested on a charge of second-degree manslaughter, ABC News reports.
Video evidence captured Penny, 24, placing Neely in a chokehold on May 1. Assistant District Attorney Joshua Steinglass informed the judge that Neely had been making threats, as witnessed by several individuals.
Authorities stated that some witnesses reported Neely yelling and harassing passengers on the train.
Police sources informed ABC News that Penny intervened without being directly threatened by Neely, who had not exhibited violence or targeted any specific individual with threats.
It is worth noting that Neely was homeless at the time of this incident.
