Former President Donald Trump is seeking an extension of the delay in his election interference trial by appealing to the Supreme Court.
Trump claims immunity from prosecution, asserting that he is charged with plotting to overturn his 2020 election loss.
His legal team filed an emergency appeal on Monday, just four days after the justices heard a separate appeal from Trump.
This appeal aimed to allow him to stay on the presidential ballot despite efforts to remove him due to his actions following the 2020 election loss.
“Without immunity from criminal prosecution, the Presidency as we know it will cease to exist,” Trump’s lawyers wrote in their statement.
The submission maintains the suspension of what could be a groundbreaking criminal trial involving a former president, as the nation’s highest court deliberates on its course of action, the Associated Press reported.
This move adheres to the deadline set by the federal appeals court in Washington, which rejected Trump’s claims of immunity and permitted the trial to move forward.
The Supreme Court’s decision, as well as the speed at which it decides, may determine whether the leading candidate in the Republican presidential primary faces trial before November.
While there is no specified timeframe for the court’s response, special counsel Jack Smith’s team has strongly advocated for the trial to occur this year.
Conversely, Trump has consistently sought to postpone the case.
The Supreme Court has several options, including dismissing the emergency appeal, allowing U.S. District Judge Tanya Chutkan to resume trial proceedings in Washington’s federal court.
The initial trial date was set for early March.
