Federal Judge Aileen Cannon dismissed special counsel Jack Smith’s request for a gag order against Donald Trump in the classified documents case, citing prosecutors’ failure to properly confer with Trump’s defense team.
Cannon criticized the lack of meaningful discussion before the request was made and emphasized the importance of adherence to court rules.
She highlighted the ongoing challenges in the case’s filing process as it progresses toward trial.
Cannon stated that prosecutors could reapply for a gag order once Trump’s defense team has had sufficient time to review and discuss the motion, CNN reported.
The request for a gag order arose after Trump made misleading remarks about FBI procedures during a search at his resort in August 2022.
Trump’s attorneys condemned the request as an unconstitutional attempt to stifle his speech as he runs for president.
Legal experts, including Mark Schnapp, praised Cannon’s decision, noting the importance of following court rules for consultation in such matters.
