The Justice Department plans to continue pursuing federal criminal cases against Donald Trump past Election Day, even if he wins, according to The Washington Post.
DOJ rules against prosecuting a sitting president wouldn’t apply until Inauguration Day in January.
This follows a Supreme Court ruling allowing Trump to claim immunity for certain actions from his presidency, potentially delaying a trial on federal election subversion charges.
Officials believe DOJ policy doesn’t extend to a president-elect, meaning Trump could still face trial before January 2025, CNN has reported.
Trump also faces federal charges for mishandling classified documents, with that trial indefinitely postponed due to issues with classified evidence.
