Couple sues Atlanta hospital for allegedly losing part of patient’s skull following brain surgery

A couple is suing Emory University Hospital Midtown in Atlanta after the hospital allegedly lost part of a patient’s skull following brain surgery.

Fernando Cluster required emergency surgery in September 2022 to treat a brain hemorrhage, during which a portion of his skull was removed.

When the hospital attempted to retrieve the bone flap for a follow-up surgery in November, they reportedly found multiple bone flaps with incomplete identification, preventing them from confirming which one belonged to Cluster.

As a result, Cluster had to receive a synthetic bone flap, leading to a longer hospital stay, an infection, and additional surgeries, NBC News has reported.

The couple claims this negligence caused physical and emotional damages, impaired family relationships, and left Cluster unable to work.

They are seeking unspecified general and special damages in their lawsuit.
