A federal appeals court ruled Wednesday that Texas can maintain its razor wire border wall, rejecting federal efforts to remove it.
The 5th U.S. Circuit Court of Appeals’ 2-1 decision supports Texas’ lawsuit accusing the Biden administration of trespassing on state property.
Circuit Judge Kyle Duncan stated that Texas acted to protect its property, not to regulate U.S. Border Patrol, and was likely to succeed in its claims.
Texas Attorney General Ken Paxton hailed the decision as a “huge win,” emphasizing state sovereignty and security, Fox News has reported.
The ruling intensifies ongoing legal battles between Texas and the federal government over immigration control.
