Tyler James Robinson, 22, is expected to face formal charges this week in the killing of conservative activist Charlie Kirk, which could allow prosecutors to seek the death penalty.
Robinson, held without bail in Utah County Jail, is accused of shooting Kirk from a rooftop at Utah Valley University before fleeing.
Preliminary charges include aggravated murder, felony discharge of a firearm, and obstruction of justice.
The death penalty would require prosecutors to prove an “aggravating” factor, such as creating a grave risk to bystanders.
The official charging documents, which will become public at Robinson’s first court appearance, could be filed between Tuesday and Friday, Fox News has reported.
He may also face separate federal charges.
