Open carry officially begins in Florida on Thursday, following an appeals court ruling that deemed the state’s ban unconstitutional.
The 1st District Court of Appeal ruled on September 10 that prohibiting openly carrying firearms violated the Second Amendment.
Florida Attorney General James Uthmeier instructed law enforcement not to arrest or prosecute “law-abiding citizens” visibly carrying guns.
The decision overturns a 1987 law that made open carry a misdemeanor punishable by fines or jail.
While the ruling allows open carry, Judge Stephanie Ray noted it is not absolute and remains subject to reasonable regulation.
State and federal restrictions on carrying firearms in certain locations still apply, CBS News has reported.
