A federal magistrate judge ordered that Brian Cole, the Virginia man accused of planting pipe bombs near the Democratic and Republican National Committee headquarters on Jan. 5, 2021, remain in custody ahead of trial, citing public safety concerns.
Prosecutors allege Cole planted the devices to cause terror on the eve of the Jan. 6 congressional proceedings, and that the bombs failed to detonate due to luck, not lack of effort.
The judge said home confinement and GPS monitoring were insufficient given Cole’s alleged bombmaking skills and history of acquiring explosive components.
Defense attorneys argued for his release to his grandmother’s custody, citing his autism spectrum and obsessive-compulsive disorder diagnoses and lack of flight risk, NBC News has reported.
Cole has not yet entered a plea and remains detained as the case proceeds.
