California Senate Approves Bill Making It Easier to Sue ICE Agents

California’s state Senate passed Senate Bill 747, the “No Kings Act,” on Tuesday, creating a first-of-its-kind pathway for residents to sue federal agents for civil rights violations in state court.

The bill, authored by Sen. Scott Wiener, would allow Californians to seek damages for excessive force, false arrest, and other constitutional violations, addressing gaps in federal accountability under laws like the Federal Tort Claims Act.

The measure passed on a 30-10 party-line vote, with Democrats framing it as a safeguard against federal overreach and Republicans warning it could increase litigation risks for law enforcement.

Supporters argue the bill empowers victims of federal abuse, while opponents say it could overlap with existing protections under the state’s Bane Act, KQED has reported.

SB 747 now moves to the Assembly, though analysts predict it will likely face a federal legal challenge if enacted.
