Bronx County Judge Guy Mitchell convicted NYPD Sgt. Erik Duran for the death of 30-year-old delivery driver Eric Duprey, who left behind three children.
The Feb. 6 bench trial resulted in a felony conviction carrying a maximum of 15 years in prison, and Duran was immediately fired by the NYPD.
Security footage showed Duran, who was undercover, throw a cooler at Duprey while he fled on a scooter during an alleged drug sting, causing Duprey’s fatal fall.
Duran, who joined the NYPD in 2010 and became a sergeant in 2018, is the first officer in nearly a decade to be convicted for killing someone, USA Today has reported.
His sentencing is set for March 19, and the NYPD union has vowed to appeal, calling the verdict a “miscarriage of justice.”
