Trump reacted angrily, calling some justices “disloyal” and threatening foreign influence without evidence, while pledging to pursue a new 10% global tariff under a rarely used law.
Chief Justice John Roberts wrote for the majority that Trump’s use of emergency powers was unconstitutional, while Justices Kavanaugh, Alito, and Thomas dissented, with Kavanaugh calling his dissent “genius.”
The ruling leaves unresolved whether businesses can seek refunds for the $133 billion already collected, with potential complications for companies like Costco, the AP has reported.
Despite the setback, Trump said he still has legal pathways to impose tariffs under other laws, though with more limits on speed and scope.
