The IRS broke the law by disclosing confidential information to ICE, judge says

A federal judge ruled that the IRS illegally disclosed confidential taxpayer information to Immigration and Customs Enforcement (ICE) roughly 42,695 times, violating IRS Code 6103.

U.S. District Judge Colleen Kollar-Kotelly found that the IRS shared addresses of thousands of taxpayers with ICE under a controversial data-sharing agreement meant to identify undocumented immigrants.

The disclosure came from 47,000 of 1.28 million requested records, often including additional address details in violation of privacy rules.

The government is appealing, but the decision is bolstered by IRS Chief Risk Officer Dottie Romo’s declaration, which confirmed the improper disclosures, the AP has reported.

Several ongoing cases continue to challenge the IRS-DHS agreement, and preliminary injunctions remain in place blocking large-scale data transfers and ICE from using IRS information.
