A Venezuelan man who was shot by an ICE officer while delivering a DoorDash order in Austin was transferred from a hospital to a detention center with the bullet still lodged near his spine, according to his lawyer.

His attorney said Wilber Rafael Garces Perez was shot after an ICE officer sideswiped his car, and the officer has since been placed on administrative leave while the shooting is investigated.

Garces Perez said he was in significant pain and was not receiving the medical care or pain medication he needed at the detention center.

His lawyer said he entered the U.S. in 2024 through the CBP One program, had a work permit, and was seeking asylum but received a deportation order after missing a court hearing because notice was sent to an old address, CBS News has reported.

A federal judge has temporarily blocked his deportation, while federal authorities investigate the shooting and officials face calls to release any available body-camera footage.
