A Maryland man, James Fitzsimmons, has been charged with second-degree murder after police say he pushed another man into Baltimore’s Inner Harbor.

Authorities allege Fitzsimmons and James Britt fought in an alley before Britt retreated toward the water, where Fitzsimmons allegedly pushed him in.

Fitzsimmons reportedly told investigators that Britt jumped into the harbor himself and walked away after learning Britt could not swim.

Rescue divers later found Britt, who was pronounced dead at a hospital, the AP has reported.

Fitzsimmons also faces manslaughter and assault charges and is scheduled to appear in court on Aug. 27.
