Lindsay Clancy returned to court as her attorneys asked a Massachusetts judge to prevent a retrial and find her not guilty in the deaths of her three children.

Her first trial ended in a mistrial after one juror prevented the 12-member jury from reaching a unanimous verdict on whether she was guilty or not criminally responsible.

Clancy’s lawyers argue that the evidence supported their claim that she was suffering from postpartum psychosis and did not understand that her actions were wrong.

Prosecutors have not said whether they will retry Clancy, but possible options include a new trial, lesser charges or a plea agreement, The Guardian has reported.

The judge is expected to consider the defense’s motions, including arguments about double jeopardy and the conduct of the holdout juror, at a hearing scheduled for November 2.
