Federal prosecutors have charged a Venezuelan delivery driver who was shot by an ICE officer in Austin, Texas, with assaulting a federal officer, according to court documents. 

The man, Wilber Rafael Garces Perez, was shot while working for DoorDash and was later taken into ICE custody while still suffering from his injuries.

Authorities say he had a final deportation order, while his attorney says he entered the U.S. lawfully, had a work permit and was seeking asylum.

The ICE officer involved was reportedly not wearing a body camera, and the circumstances leading to the shooting remain under investigation, CBS News has reported.

The case has drawn calls for greater transparency as Garces Perez faces federal charges while his attorney challenges his detention and seeks further information about the shooting.
